ScoreAI Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of ScoreAI, a platform for screening and vetting candidates for Job positions in several industries ("ScoreAI" or the "Platform"), operated by Simbiosis Inc ("we," "us," or "our"). By accessing or using ScoreAI, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not access or use ScoreAI.
1. Eligibility
1.1 ScoreAI is intended for use by individuals who are at least 18 years old. By accessing or using ScoreAI, you represent and warrant that you are at least 18 years old.
2. User Accounts
2.1 To access certain features of ScoreAI, you may need to register for an account. When registering for an account, you agree to provide accurate, current, and complete information about yourself or your company as prompted by the registration form, and to promptly update such information as necessary to ensure its accuracy.
2.2 You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree not to disclose your account credentials to any third party and to notify us immediately if you suspect any unauthorized access to or use of your account.
3. Subscription and Payment
3.1 Companies may access ScoreAI by subscribing to a monthly subscription plan or purchasing credits for the service. The subscription fees or credit costs are detailed on the Platform and are subject to change at our discretion.
3.2 By subscribing to a monthly plan or purchasing credits, you agree to pay the applicable fees in accordance with the terms specified on ScoreAI.
3.3 All payments are non-refundable except as expressly provided in these Terms or as required by applicable law.
4. Use of ScoreAI
4.1 ScoreAI provides a platform for companies to upload job positions and evaluate candidates based on their criteria. Candidates provide information such as resumes, personal information, and experience, and undergo assessments via video and voice interfaces to evaluate technical and communication skills.
4.2 You agree to use ScoreAI solely for its intended purposes and in compliance with these Terms, all applicable laws, regulations, and guidelines.
5. Content
5.1 You acknowledge and agree that all content provided by companies and candidates on ScoreAI, including job positions, resumes, personal information, and assessment results, is the sole responsibility of the respective users. We do not endorse, guarantee, or assume any responsibility for the accuracy, completeness, or legality of such content.
5.2 By providing content on ScoreAI, you grant us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purposes of operating and improving ScoreAI.
6. Privacy
6.1 Our collection and use of personal information in connection with ScoreAI are governed by our Privacy Policy, available at https://getscore.ai/privacy-policy. By accessing or using ScoreAI, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
7. Intellectual Property
7.1 ScoreAI and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on ScoreAI except as expressly permitted by these Terms.
8. Termination
8.1 We reserve the right to terminate or suspend your access to ScoreAI, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
8.2 Upon termination, your right to access or use ScoreAI will immediately cease, and you must immediately cease all use of ScoreAI.
9. Limitation of Liability
9.1 In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use ScoreAI; (ii) any conduct or content of any third party on ScoreAI; (iii) any content obtained from ScoreAI; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Modifications
10.1 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11. Governing Law and Dispute Resolution
11.1 These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.
11.2 Any dispute arising out of or relating to these Terms or ScoreAI shall be resolved exclusively by the competent courts located in Delaware.
12. Entire Agreement
12.1 These Terms constitute the entire agreement between you and us regarding your access to and use of ScoreAI, superseding any prior agreements between you and us regarding ScoreAI.
